“According to the CPSC, an 8-month-old girl from Bryan, Texas, died because the safety pegs on her crib were missing. The crib’s side detached, leaving a gap in which she got trapped and suffocated. The CPSC has also gotten reports of two entrapments and nine disengagements in cribs with missing safety pegs.” (See the Consumer Reports article)
When confronted with the puzzling, tragic death of an infant who suffocated in her crib, Waltman & Grisham attorneys rose to action to answer the grieving family’s fervent questions of “how” and “why.” In our quest for information, we learned that several other similar deaths had occurred, but parents were almost routinely blamed for the death of their own child due to improper assembly of the product. However, because of our steadfast belief in our client, we were compelled to look further. Through tedious investigation and leg work, we discovered that the foreign-manufactured cribs were missing the “safety pegs” – a very small, yet highly critical component that was not supplied with the crib. We reported our findings to the Consumer Products Safety Commission. CPSC sent representatives to our facility where we demonstrated the defect and pointed out the almost non-existent instructions related to its installation and use. The “safety peg” was not even mentioned in the step-by-step assembly instruction. Thereafter, almost 1 million cribs were recalled due deaths caused by missing “safety pegs.”
SAFER FUEL SYSTEMS
With over 25 years of experience in investigating and prosecuting cases against automobile manufactures for defects in fuel systems, the team at Waltman & Grisham was honored to represent two families who experienced unimaginable loss arising from two separate rear collisions with their Jeep Cherokee SUV’s. Because of a lack of proper structure surrounding the fuel tanks, and because of the fuel tank’s placement behind the axle of the vehicles, the tanks were subject to rupture and spilling of fuel when struck from the rear in a traffic accident. Through the efforts of consumer safety advocates, government investigators, and attorneys across the nation, including Waltman & Grisham, the National Highway Traffic Safety Administration (NHTSA) initiated a recall of several series of Grand Cherokee vehicles with rear (behind-the axle) fuel tanks. Waltman & Grisham joined with safety groups, victims, and other attorneys in a joint meeting with the Director of NHTSA to present the facts surrounding Jeep fuel tank performance in rearward collisions. These events deeply affected our client’s families, and we were honored to be able to tell their stories in Washington. As a result of NHTSA’s investigation, the dangerous condition of the vehicles was brought into the light, and through a Consent Order, Chrysler agreed to make repairs.
